This policy explains how to submit a DMCA notice of alleged infringement, how we respond, how to submit a counter-notice, and how we handle repeat infringers.

1) DMCA Notice of Alleged Infringement

If you believe that material available on this Site infringes your copyright, you may submit a written DMCA notice to our Designated Copyright Agent. Your notice must include all elements required by 17 U.S.C. §512(c)(3):

  • Signature: a physical or electronic signature of the copyright owner or authorized agent.

Incomplete or improperly formatted notices may be delayed or deemed invalid.


2) Our Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will promptly review the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

When feasible, we will notify the user or content provider responsible for the material and provide information about submitting a counter-notice.

We aim to respond to properly completed DMCA notices within 2–3 business days during our normal operating hours.


3) Counter-Notice Procedure

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice containing the following:

  • Identification of the material that was removed or disabled and the location where it appeared before removal.

  • Statement under penalty of perjury that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.

  • Your contact information, including full legal name, mailing address, telephone number, and email address.

  • Consent to jurisdiction: a statement that you consent to the jurisdiction of the United States District Court for the State of California, and that you will accept service of process from the person who submitted the original DMCA notice or their agent.

  • Signature: physical or electronic.

Unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing material, we may restore the material within 10–14 business days after receiving a valid counter-notice.


4) Repeat Infringer Policy

In appropriate circumstances and at our sole discretion, Art School Records Store by Ahst 131 LLC may suspend or terminate accounts or restrict Site access for users who are determined to be repeat infringers.


5) Misrepresentations (17 U.S.C. §512(f))

Any person who knowingly misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, under 17 U.S.C. §512(f).


6) How We Handle Notices

  • We may forward a copy of your DMCA notice or counter-notice (including your contact information) to the user who posted the material.

  • We may retain records of notices, counter-notices, and related actions for legal compliance, auditing, and dispute resolution purposes.
